The Council has a legal responsibility to investigate nuisance
complaints relating to air pollution under the Environmental
Protection Act 1990. This can relate to emissions of smoke
from bonfires, fumes, dust and odour.

The Council has a policy to try and resolve complaints about
emissions from domestic premises by informal means in the first
instance, but where a nuisance is established, a formal abatement
notice would be served on the polluter, requiring them to stop the
nuisance. In extreme cases, where the polluter fails to take heed
of the notice, a prosecution can be taken out in the magistrates'
court. If convicted, an individual can be fined up to a maximum of
£5,000. Where the offence is committed on industrial, trade or
business premises, the maximum fine is £20,000.
In addition certain types of smoke emission from industrial
trade and business premises are controlled under the Clean Air Act
1993.
