Hackney Carriage Vehicles
Hackney Carriage Hackney carriage is often referred to as a taxi and do not need to be pre-booked.
In order to comply with Taxi and Private Hire Licensing Policy, if you are intending to licence a hackney carriage vehicle, it should be purpose built with access for at least one wheelchair and be of suitable design, Appendix G of the policy document shows examples of the types of vehicles considered suitable for hackney carriage use. You are advised to contact the Licensing team before purchasing a hackney carriage vehicle to ensure it will comply with licensing requirements and licence conditions.
There is no maximum age limit on vehicles that will be considered for licensing. However, the vehicle must undergo and pass a vehicle compliance test at the Councils nominated garage before a licence can be issued. The cost for each compliance test is £48, payable directly to the garage.
Vehicle testing is carried out at the council's nominated garage in Essington, South Staffordshire.
There are two types of test:
The full test lasts about one hour and includes a full MOT, together with an additional check. The additional check ascertains the suitability of the vehicle to be used as a licensed vehicle. The test covers items such as the general condition of the vehicle, possible accident damage and the examination of items such as the fire extinguisher and first aid kit.
The interim vehicle test is carried out following the expiry of a 4 month or 6 month licence (depending on vehicle age). These tests are designed to ensure that vehicles are maintained to a minimum standard and comply with all aspects of the licence. The number of tests depends on the age of the vehicle from the date of first registration.
The vehicle must be insured for Public Hire and in the case of an "Any Driver" policy, the insurance certificate must be accompanied by a schedule of drivers who have been declared to the Insurance Company.
Once you have purchased a vehicle, you should contact the Licensing team to arrange an appointment to submit the application.
When attending your appointment, you must bring with you the following:
- Completed application form
- Vehicle Registration document V5C (logbook)
- current insurance certificate
- garage test pass certificate
- taxi meter calibration certificate
- application fee
- SVA Certificate (if applicable)
- Tail Lift Certificate (if applicable)
- LPG Conversion Certificate (if applicable)
If you forget any of the above items when you attend to make your application, your application will not be accepted and a further appointment will have to be made.
When you attend your appointment you will be given a bracket that must be permanently fixed to the rear of the vehicle.
A vehicle must not be used as either a hackney carriage or private hire vehicle unless the licence has been obtained.
If you wish to cancel a pre-arranged appointment you must do so at least 48 hours before the scheduled appointment. All licensed hackney carriage vehicles in South Staffordshire must pass the council's vehicle test before a licence will be issued.
If you wish to be a hackney carriage driver but live outside of South Staffordshire we require information, pursuant to section 57 of the Local Government (Miscellaneous Provisions) Act 1976 as to whether you intend to use the vehicle in South Staffordshire District or rather outside of the district.
You will need to be able to show what proportion of your business you propose to carry out in South Staffordshire and what business will be carried out elsewhere and in particular where.
If we have concerns that the hackney carriage is to be used primarily outside of this area then the decision on whether to licence you would be referred to the Licensing and Regulatory Sub-Committee.
This is in accordance with the decision in R (App Newcastle City Council) v Berwick-upon-Tweed Borough Council  EWHC 2369
