Licence Transfers


Once granted it is possible to transfer a licence to another person/ business. The person who seeks to have the licence transferred them ought to check the conditions of licence are suitable for the business model and that they can comply with them. This is because they will inherit any conditions, some of which may be onerous, with the licence transfer.

A transfer can, when applied for, be of immediate effect however the police have 14 days to object to the transfer if they are of the view that transfer to a particular person/ body would “in the exceptional circumstances of the case" undermine what is known as the crime prevention objective ie the licence holder's obligation to prevent crime and disorder. If the police do object they will give the council a notice stating so and give their reasons.

Whether the transfer takes place is then a matter for the council's licensing sub- committee who will consider what the police have to say as well as the potential licensee.

If the sub-committee should refuse the application then an appeal can be made through the magistrates court.
