South Staffordshire Council is proposing to put in place a Public Spaces Protection Order on the A449 (from the Coven Roundabout at the junction with Brewood Road to Junction 2 M54); Brewood Road, Old Staffordshire Road, New Road (the link between the A449 and A460); and the A460 (from Junction 11 M6 to the roundabout on Junction 1 M54) and as part of the consultation process within the legislation we are asking for your feedback on the proposal outlined below.
PSPOs are one of the tools available under the Anti-Social Behaviour, Crime and Policing Act 2014 and can be used to restrict a broad range of activities. Under section 59 of the 2014 Act, South Staffordshire Council must be satisfied on reasonable grounds that the activity subject to an Order:
• has a detrimental effect on the quality of life of those in the locality (or it is likely that activities will take place and have such an effect)
• is (or is likely to be) persistent or continuing in nature
• is (or is likely to be) unreasonable
• justifies the restrictions being imposed.
The Proposal for the Public Spaces Protection Order:
Within the Public Spaces Protection Order the type of anti-social behaviour that will not be acceptable is identified and the prohibitions will state that it is an offence to:
- Engage in, promote, encourage or assist in revving of engines, driving at high speeds, car cruising, wheel spinning, loud music, drifting, screeching tyres of any type of motorised vehicle.
- Congregate or loiter as part of a group around (or in) stationary vehicles when it is likely to cause noise, harassment, alarm or distress.
- Act in an anti-social manner causing alarm, harassment or distress to residents, businesses or other road users.
The penalty for breaching these prohibitions will be a £100 Fixed Penalty Notice or the possibility of prosecution and a fine of up to £1,000.
Section 59 of the Police Reform Act 2002 will run alongside the PSPO where police can seize vehicles caught acting in an anti-social manner within the designated area too.
