Section 106 Agreements

Planning obligations under Section 106 of the Town and Country Planning Act 1990 (as amended), commonly known as Section 106 Agreements (S106), are a mechanism which make a development proposal acceptable in planning terms, that would not otherwise be acceptable. They are focused on site specific mitigation of the impact of development. S106 agreements are often referred to as 'developer contributions.

For a copy of a S106 agreement there is a fee of £10.00 per agreement.

Standard Section 106 Agreements

The Staffordshire Local Planning Authorities, including the County Council, have come together to produce a standardised template for Section 106 Agreements across Staffordshire. We have committed to publicising this upfront so applicants are clear what documentation we require them to complete as part of the application process. This will reduce delays and costs for applicants and simplify the planning process.

The standard template has optional schedules which will be applied according to the nature of any proposed development. We do not envisage entering into dialogue with applicants with regards to amendments to the main body of the obligation, other than removing references which are plainly not applicable, as the template has been agreed by the County Council and other planning authorities.

Section 106 Bidding

Planning permission was granted for housing at Beggars Bush Lane, under planning application 18/00559/OUT this was subject to the applicant signing a Section 106 agreement, part of which was a contribution of £76,000 (index linked) to be spent on the provision of off-site allotments and/or new or improved leisure/sporting facilities within Wombourne Village.

The full amount plus indexation has been received, and the total amount we now hold is £83,564.08.

We have a Section 106 Panel, made up of Members and Officers, who will consider bids for the monies available and then decide where the available monies should be awarded.
